These Terms & Conditions (“Terms”) govern your access to and use of the XploreC platform, website, content, tools, and communications. By creating an account, purchasing a subscription, accessing the platform, receiving emails from XploreC, or using any XploreC content, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use XploreC.
1) What XploreC Provides
XploreC is an analytical and technical market-analysis service intended to help users identify market zones and levels, multi-timeframe trend context, and scenario-planning information for certain financial instruments. XploreC may publish analysis in the form of written commentary, charts, zone or level markings, summaries, and other educational material through the platform and, where enabled, via email delivery. XploreC does not execute trades on your behalf and does not operate as a broker, exchange, investment manager, or custodian.
2) No Investment Advice, No Signals, No Recommendations
All information provided by XploreC is for general educational and informational purposes only and is not intended as investment advice, trading advice, legal advice, tax advice, or any other regulated advice. XploreC does not provide personalized recommendations, does not provide trade signals, and does not recommend that you buy, sell, hold, or transact in any security, derivative, digital asset, fund, or other financial instrument. Any reference to “potential,” “high-potential,” “direction,” “zones,” “levels,” “setups,” or similar language reflects analytical opinions within XploreC’s methodology and must not be interpreted as instructions to trade. You remain solely responsible for your decisions, your risk management, and confirming the legality and suitability of any instrument or strategy for your circumstances and jurisdiction.
3) Risk Disclosure
Trading and investing involve substantial risk and are not suitable for everyone. You can lose some or all of your capital, and depending on the product, market, or broker terms, losses may exceed your initial deposit, particularly where margin or leverage is involved. Market conditions may change rapidly, and execution factors such as spreads, slippage, gaps, illiquidity, outages, delays, and pricing anomalies can materially affect outcomes. You agree that you will only risk funds you can afford to lose without affecting your lifestyle and that you are solely responsible for determining whether trading is appropriate for you.
4) Past Performance, Hypothetical Results, and Backtesting
Any examples, performance references, case studies, statistics, charts, or references to backtesting, including systematic testing and EA-based testing, are provided for illustrative purposes only. Backtests and hypothetical results have inherent limitations and may not reflect actual trading conditions, including execution timing, transaction costs, spreads, slippage, liquidity constraints, market disruptions, and changes in market regimes. You acknowledge that past performance, whether actual or simulated, is not indicative of future results and that no representation is made that any outcome will be achieved.
5) Eligibility and User Responsibilities
You represent and warrant that you are at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, and that you have the legal capacity to enter into these Terms. You further represent and warrant that you will access and use XploreC only where such use is legal and that you will comply with all applicable laws, regulations, and rules that apply to you. You are responsible for ensuring that your use of XploreC does not violate any restrictions that may apply in your country of residence or citizenship, or any professional or regulatory obligations that apply to you.
6) Accounts, Access, and Security
To use certain features, you may be required to create an account and provide accurate, complete, and current information, and you agree to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether authorized by you or not. You agree to notify XploreC promptly if you suspect unauthorized access or a security breach affecting your account. XploreC may suspend or restrict access to protect users, the platform, or compliance obligations where XploreC reasonably believes an account is compromised or is being used in violation of these Terms.
7) Subscriptions, Billing, Renewals, and Refunds
Certain content and features are offered through paid subscriptions (“Subscriptions”), and the prices, billing periods, and plan features are described on the relevant pricing or checkout pages at the time of purchase. By purchasing a Subscription, you authorize XploreC and or its payment processor to charge the applicable fees, taxes, and recurring charges according to your chosen billing cycle. Unless explicitly stated otherwise at checkout, Subscriptions renew automatically at the end of each billing period until canceled by you. You may cancel renewal through your account settings or by contacting support, and cancellation prevents future renewal charges but does not retroactively refund amounts already paid, except where required by applicable law or where a written refund policy applies. Any free trials, discounts, or promotional terms, if offered, will be disclosed at signup or checkout and may convert into a paid Subscription unless canceled before the conversion time. Refund eligibility, if any, is governed by the refund policy displayed on the website and by applicable consumer laws in your jurisdiction, and those rules may vary depending on your location and the nature of digital content delivery.
8) Delivery by Email and Notifications
If your plan includes email delivery or notifications, you may receive emails containing analysis outputs, including trend context, timeframes, zones or levels, and links to related platform content. Email delivery is provided on a best-effort basis, and you acknowledge that delivery may be delayed, filtered, blocked, or interrupted by factors outside XploreC’s control, such as spam filtering, ISP policies, mailbox limits, misconfigured settings, incorrect addresses, or third-party outages. You are responsible for providing an accurate email address, maintaining your ability to receive emails, and checking your spam or promotions folders if messages are not received.
9) Coverage, Availability, and Changes to Content
XploreC may cover a range of instruments and markets, but you acknowledge that coverage may vary and may change over time due to data availability, liquidity considerations, platform updates, regulatory constraints, or operational decisions. XploreC does not guarantee that any instrument, timeframe, feature, or content format will be available at all times or will remain available indefinitely. XploreC may add, remove, modify, or discontinue any aspect of the service, including features, analysis formats, methodologies, supported markets, or delivery methods, and such changes may occur without notice where required for security, compliance, or operational reasons.
10) Intellectual Property and License
All content and materials made available through XploreC, including text, charts, images, layouts, zone markings, labels, methodologies, software, and branding, are owned by XploreC or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, XploreC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the content for your personal, non-commercial use during an active subscription period or authorized access period. You may not copy, reproduce, distribute, sell, sublicense, rent, share, publicly display, or otherwise exploit the content except as expressly permitted in writing by XploreC, and you may not use the content to develop, train, or operate a competing service or product.
11) Acceptable Use
You agree to use XploreC in a lawful manner and in a way that does not harm the platform, other users, or third parties. You agree not to attempt to gain unauthorized access to any systems, not to interfere with the security or operation of the platform, not to introduce malware or harmful code, and not to scrape, crawl, or automate access to the platform at scale except where explicitly permitted in writing. You agree not to share accounts or credentials with others unless your plan expressly allows it, and you agree not to republish member-only material, including screenshots or copies of analysis, without written permission. XploreC may suspend, restrict, or terminate access if it reasonably believes you have violated this section.
12) Third-Party Services, Links, and Data Sources
XploreC may rely on third-party providers for services such as market data, hosting, analytics, email delivery, and payment processing, and XploreC may include links to third-party websites or resources. XploreC does not control third-party services and does not guarantee their availability, accuracy, or suitability, and your use of third-party services is governed by their own terms and policies. You acknowledge that interruptions, inaccuracies, delays, or changes in third-party services may affect XploreC’s delivery or presentation of information and that XploreC is not responsible for third-party acts or omissions.
13) Disclaimers (As-Is / No Warranty)
XploreC is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, XploreC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, timeliness, and uninterrupted availability. XploreC does not warrant that the service will be error-free, that any analysis will produce a desired outcome, or that any market will behave in accordance with any analysis. You acknowledge that markets are probabilistic, that analysis can be wrong, and that any use you make of the content is at your sole risk.
14) Limitation of Liability
To the maximum extent permitted by law, XploreC and its owners, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, trading losses, or investment losses arising out of or relating to your access to or use of XploreC. To the extent that liability cannot be excluded, XploreC’s total liability for any claim will be limited to the total amount you paid to XploreC in the three (3) months immediately preceding the event giving rise to the claim, or such other minimum or maximum amount as required by applicable law. Nothing in these Terms limits liability for matters that cannot be limited under applicable law, such as fraud or intentional misconduct.
15) Indemnification
You agree to indemnify, defend, and hold harmless XploreC and its affiliates, and each of their respective officers, directors, employees, and contractors, from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to your breach of these Terms, your misuse of the platform, your violation of any law or regulation, or your infringement of any third-party rights. This indemnity obligation applies to claims brought by third parties and to the extent permitted by law.
16) Suspension and Termination
XploreC may suspend, restrict, or terminate your access to the platform or any portion of it at any time if XploreC reasonably believes you have violated these Terms, if your payment fails or is reversed, if required to comply with legal obligations, or if necessary to protect the security and integrity of the service. You may stop using XploreC at any time, and you may cancel your Subscription renewal as described in these Terms. Upon termination or expiration of access, your license to use the content ends, and you must stop using and delete any member-only content not permitted to be retained. Sections that by their nature should survive termination, including intellectual property protections, disclaimers, limitation of liability, and indemnification, will survive.
17) Changes to These Terms
XploreC may update these Terms from time to time, including to reflect changes in the service, legal requirements, or business practices. If changes are material, XploreC will provide reasonable notice by posting updated Terms with a new effective date and or by notifying you through the platform or by email. Your continued use of XploreC after the effective date of updated Terms constitutes your acceptance of the updated Terms.
18) Privacy and Data Protection
XploreC’s collection and processing of personal data is governed by the XploreC Privacy Policy located at [insert link], which is incorporated into these Terms by reference. By using XploreC, you acknowledge that you have read and understood the Privacy Policy and that you consent to the processing of your data as described there, subject to any rights you may have under applicable data protection laws. Where required, XploreC will obtain consent for marketing communications, and you may unsubscribe from marketing emails in accordance with applicable law and the instructions provided in such communications.
19) Governing Law and Dispute Resolution
These Terms are governed by the laws of [Insert governing law jurisdiction], without regard to conflict-of-law principles, unless mandatory consumer protection laws in your jurisdiction require otherwise. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of XploreC will first be addressed in good faith through informal negotiations by contacting XploreC at [insert contact email]. If the dispute is not resolved within a reasonable period, the dispute will be submitted to the competent courts located in [Insert venue], unless applicable law requires a different venue or grants you the right to bring claims in your local courts. 20) Confidentiality and No Sharing of Results
You acknowledge that the outputs and results produced by XploreC, including (without limitation) trading zones, key levels, trend clarification, multi-timeframe trend context, scenarios, annotations, screenshots, summaries, and any member-only content (collectively, the “Results”), are proprietary and confidential. You agree that you will not share, distribute, publish, forward, sell, sublicense, transmit, display, or otherwise make the Results available to any third party, whether publicly or privately, in any form, including via social media, messaging apps, communities, or file-sharing services, without XploreC’s prior written permission. Any attempt to share the Results is strictly prohibited and constitutes a material breach of these Terms. XploreC may, in its sole discretion and without limiting any other rights or remedies, suspend or terminate your account immediately for any breach of this section, revoke access to the platform, and pursue all available legal and equitable remedies. All the suggested setups are either based on extensive backtesting or on values recommended from XploreC's previous experience working with the system. These setups may be fixed or changed; the user will be notified of any necessary changes.
21) Miscellaneous
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law. You may not assign or transfer your rights or obligations under these Terms without XploreC’s prior written consent, and any attempted assignment in violation of this section is void, while XploreC may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms, together with any documents incorporated by reference, including the Privacy Policy and any refund policy presented at checkout, constitute the entire agreement between you and XploreC regarding your use of the service and supersede any prior or contemporaneous agreements or communications. Any failure by XploreC to enforce a provision of these Terms is not a waiver of the right to enforce that provision later.
